PDFCook County Issues New Administrative Order Regarding Foreclosures

Pursuant to Cook County Chancery Division General Administrative Order 2021-07, effective October 7, residential and commercial foreclosures may resume in their entirety.
Previously, foreclosing lenders could proceed through judgment of foreclosure, but were stayed from scheduling or holding sales unless the property was vacant or abandoned. The holds and additional COVID-related impediments to foreclosure imposed by the Cook County Court have been removed.
The 2021-07 order encourages lenders to communicate with borrowers about foreclosure and assistance options that may be available. If such communication is made, lenders should retain copies of them and any responses.
Additionally, the Illinois eviction moratorium expired on October 4.
