Bio
Mitchell McIntyre serves as the firm’s Torts & Litigation and Transportation Law Department Leader. With over 12 years of experience, Mr. McIntyre focuses his practice in the areas of Michigan No-Fault personal injury protection benefits, catastrophic injuries, uninsured and underinsured motorist benefits, commercial trucking and third party transportation liability, special investigations and medical provider fraud.
In addition to transportation, Mr. McIntyre also has experience representing clients in cases involving all aspects of insurance coverage, life insurance, products liability, civil RICO actions and premises liability.
A member of the firm’s Bloomfield Hills office, Mr. McIntyre is a sought-after writer and speaker on issues involving Michigan No-Fault, statutory reform, fraud and insurance coverage issues. He has also authored numerous articles including the Michigan Chapter for Uninsured and Underinsured Motorist Benefits Coverage for the nationwide compendium published by the DRI.
Mr. McIntyre graduated, cum laude, from Wayne State University where he received numerous academic awards, including the Silver and Bronze Key awards and served as a senior oralist for the school’s moot court.

Serves as lead Michigan panel counsel for one of the world’s largest transportation network companies and has won numerous motions for summary disposition and summary judgment in connection with high exposure litigation related to transportation network companies and their insurance carriers.

Routinely assists with development of special investigations and recently investigated over $750,000 in pre-suit claims by the same medical provider involving more than 40 patients. Successfully developed a motion for declaratory judgment predicated on novel violations of the public health code that was granted in Wayne County Circuit Court, resulting in subsequent voluntary dismissal of over 30 other active lawsuits and elimination of all indemnity exposure.

Co-chaired jury trial in Ingham County Circuit Court on a high exposure third party negligence case filed by a police officer alleging a traumatic brain injury against a driver that impacted a police cruiser while its lights were activated and the officer was responding to an emergency. The jury returned a verdict of no cause of action in favor of the defense.

Served as lead counsel in a high exposure priority case originally filed in state court against a client in a dispute over whether a personal carrier or trucking company carrier was responsible for catastrophic PIP benefits. Mr. McIntyre had the state court action removed to federal court on the basis of fraudulent joinder and filed a counter-complaint for reimbursement. Ultimately prevailed on summary judgment, resulting in an award of over $400,000 paid to the client, in addition to elimination of a future lifetime exposure.

Prevailed on summary disposition on an issue of first impression in Michigan with over $10 million in alleged damages. The issue involved whether an arbitration provision in a transportation network company’s terms of service was enforceable against personal injury claimants.

Organized multiple investigation projects for carriers involving systemic provider abuse and mediations involving large collections of patients and pattern evidence related to civil RICO.

Well versed in high-exposure litigation and wrongful death cases, working with catastrophic claim funds and reinsurance.

Handled over 600 cases to conclusion as lead counsel, including all aspects of litigation from pre-suit through summary disposition/judgment, mediation, arbitration and trial.

Community Involvement
- Special Olympics of Michigan - Mr. McIntyre is actively involved in the Special Olympics, and he annually runs a fundraising team that participates in the Polar Plunge every February. This involves jumping through the ice into freezing water every year to raise money for the Special Olympics. Mr. McIntyre’s team has raised over $75,000 since 2012.
