PERSUADING A NEW GENERATION OF MILLENNIAL JURORS

As the number of millennial jurors increases, it is important to understand how these individuals differ from prior generations. Millennials are truly unique because they have grown up in the age of the internet and social media, which research has shown can change the way our brains actually work. The goal of this presentation was to offer practical strategies the defense can use to appeal to millennial jurors.
LEVERAGING SOCIAL MEDIA FOR THE DEFENSE
In 2018, over 77 percent of the U.S. population had a social media profile, a number that has grown steadily over the previous decade. Evidence gleaned from social media platforms is fair-game for discovery in medical malpractice cases and can be invaluable to the defense. This presentation addressed how social media evidence can be used throughout the litigation process as a powerful tool for the defense.

Presented by a former medical liability plaintiff attorney, this segment provided a brutally honest insider’s take on what makes the plaintiffs’ bar tick. It also explored how plaintiff attorneys exploit the momentum of litigation and the danger of losing the forest for the trees when your case progresses to trial.
THE VALUE OF ECONOMISTS & LIFE CARE PLANNERS AS EXPERTS

In cases involving serious injuries, you will likely encounter a life care plan created by the plaintiff’s own life care expert. Frequently, these plans liberally project the injured plaintiff’s future medical needs and the total costs to cover them over the injured person’s lifetime, so creating an aggressive rebuttal strategy is key to a successful defense. How can a defense focused life care planner or economist help your case? We had answers.
PANEL DISCUSSION WITH THE REAL EXPERTS
We consider our clients to be the real experts when it comes to litigation, so we asked a number of them to share their thoughts on a range of topics, including those covered during the seminar. We explored such issues as the value of enlisting focus groups during mock trials, the use of attorneys to second chair trials and whether it makes sense to enlist appellate counsel to monitor trials and arbitrations.
