Avoiding Plaintiffs' Lottery Tickets
Dealing with Denney, Economic Experts & Blackboard Damages
Originally Held: May 20, 2021
Time: 11 a.m. to noon
Cost: Complimentary
Program Description:
The speed with which the fingers of some damages experts can fly over calculator keys can be dizzying even to the most seasoned trial and appellate attorneys.
That’s why we thought it was important to take a step back to look at how economic experts in catastrophic injury cases typically blackboard lost earning capacity, future medical costs and household services in the course of litigation. Left unchallenged, their calculations can lead to jury awards that rival the size of some lottery winnings!
This webinar took an in-depth look at successful tactics for challenging such costs based on reasonable approaches to life expectancy, lien costs and reduction to present value. We discussed techniques to attack the economic experts on the merits at trial, but we also offered tools to reduce or eliminate the various categories of damages before ever getting the first settlement demand in mediation or offering the first witness at trial. We also examined applicable case law like Denney v Kent County, Langell v McLaren, and recent developments in Michigan’s appellate courts.
Who Should Attend:
This webinar was designed to benefit insurance claims professionals, risk managers and business owners who are involved in litigation. There is no cost to attend, so please share this invitation to register with your colleagues
