Employers face stiff fines and significant tax liability and violations under the
Fair Labor Standards Act (FLSA) when they misclassify workers as independent contractors instead of employees or misclassify employees as exempt
(salaried) employees when they should have been paid on an hourly
basis and received overtime.
During Plunkett Cooney's webinar “Misclassifying Workers," employment attorneys Laura Dinon and Claudia Orr focused on independent contractors versus employees and FLSA's exemptions (executive, administrative and professional). They also provided participants with practical tips on how to properly classify workers to avoid fines and penalties. Additional exempt classifications
were reviewed as well.
